Renting Out a Home in River Oaks

The City of Houston groups River Oaks with its neighbors as Super Neighborhood 23, the Afton Oaks / River Oaks Area. The planning department’s April 2021 profile puts it at 2,311 acres, or 3.61 square miles, with 15,477 residents, 8,365 housing units and 7,108 households in the 2015 to 2019 Census estimates. It sits in City Council Districts G and C and inside Houston ISD, between Downtown and the Uptown and Galleria area.

River Oaks itself began in the 1920s. By 1924 Country Club Estates, the section south of the new River Oaks Country Club, had been platted but not built. Will and Mike Hogg bought out the original investors, formed what became the River Oaks Corporation and installed attorney Hugh Potter as president. Kansas City landscape architects Hare and Hare drew the master plan, which buried utility lines, eliminated alleys, allowed only three intersecting streets and set aside a fifteen acre campus for River Oaks Elementary.

The developers copied ideas from Roland Park in Baltimore and the Country Club District in Kansas City: architectural controls, a private tax to fund maintenance and services, and a property owners association to enforce deed restrictions. House designs needed approval from a panel of architects and citizens. A racial covenant in the original restrictions was removed when the restrictions were renewed in 1985.

The wider area is not uniform. The city’s profile describes Afton Oaks as a post World War II subdivision whose original ranch homes are being renovated or replaced with much larger houses, and Post Oak Park in the northwest as one of the first fashionable apartment districts along Mid Lane in the 1960s, where garden apartments replaced luxury homes and townhouses as land prices rose. That mix is why the same profile counts 69 percent of households as owners and 31 percent as renters.

For a rental owner, the numbers set expectations. The profile lists a median household income of 159,378 dollars and a median housing value of 532,741 dollars, against 52,338 dollars and 171,800 dollars for Houston as a whole, and 15 percent of housing units vacant. Tenants here compare carefully, and the owners association, not just the city, often has a say in what work can be done on the house they are renting.

Neighborhoods

River Oaks Area Neighborhoods

The River Oaks area is a set of separately platted subdivisions, each with its own restrictions and its own association. Six of them and what sets each apart:

River Oaks Section 1The original Country Club Estates core. A March 15, 1926 sale added 134 lots, and the restrictions for that tract required two story houses except on 13 lots in Block 40 on what is now Pelham Drive. Houses such as the 1938 Bullington House at 3023 Del Monte have come before the city for Protected Landmark designation.
Afton OaksFounded in 1951 and made up of nine subdivisions, including Kettering Oaks, the Greenwood Addition and Sections One through Seven, with about 525 homes between Westheimer, the Southwest Freeway, Loop 610 and Mid Lane. Its civic club, chartered in 1955, enforces restrictions that bar commercial activity and limit each lot to one single family residence.
Avalon PlaceBuilt on land Dr. William Thomas Dickey bought in 1890, running 1,000 feet on each side of what is now Kirby Drive. Its sections were platted from 1931 to 1952, their restrictions were amended and restated in 2001 with a second amendment in 2018, and the Avalon Property Owners Association dates to 1979.
River Oaks Shopping Center areaThe center on West Gray at South Shepherd was built in 1936 and 1937 by the River Oaks Corporation and is described by the city as Houston's first auto centered suburban shopping center. The Texas Historical Commission found it eligible for the National Register on September 5, 2006, and the city took up landmark designation in 2007.
Post Oak ParkThe northwest corner of the super neighborhood along Mid Lane, which the city calls one of the first fashionable apartment districts of the 1960s. It holds much of the area's apartment and townhome stock, and with it a large share of the area's renters.
Bayou Bend and the Buffalo Bayou edgeRiver Oaks runs up to Buffalo Bayou and Memorial Park. Bayou Bend, Ima Hogg's fourteen acre estate at 6003 Memorial Drive, was built between 1926 and 1928, offered to the Museum of Fine Arts, Houston in 1956 and opened to the public on March 5, 1966.

What River Oaks Owners Should Plan For

Association review comes before the city permit

River Oaks Property Owners exists to review and enforce the residential building deed restrictions, and it also arranges trash collection, runs the River Oaks security patrol and cares for the parks and esplanades. Major projects and smaller changes go through its review, so a rental renovation, addition or exterior change needs association sign off on top of any city permit.

Afton Oaks and Avalon Place run their own systems. In Afton Oaks, the civic club enforces restrictions that limit each lot to one single family residence, which rules out adding a second unit on most lots. Section Seven let its restrictions lapse and now has multiple dwellings, which shows how much depends on the specific section a lot sits in. Pull the recorded restrictions for the exact lot before you budget any project.

The city can sue to enforce certain restrictions

Houston has no zoning, so deed restrictions do the work. Under Chapter 212 of the Texas Local Government Code and Sections 10-551 through 10-555 of the city code, the City Legal Department can sue for an injunction to enforce restrictions on the use of a property, setbacks, lot size, the size, type and number of structures, the orientation of a structure and certain fences that need a building permit.

That means a violation in River Oaks, Afton Oaks or Avalon Place can bring the city in as well as the association. Neighbors file through the Deed Restriction Hotline at 832-393-6333 or a written complaint form. For an owner, the cheaper path is to confirm use and structure limits before signing a lease or a contract with a builder.

Short-term rentals need a city certificate

Houston City Council adopted short-term rental rules on April 16, 2025. Registration opened in fall 2025, and from January 1, 2026 every short-term rental needs a city registration, with a 275 dollar annual fee per property. Hosts must display a 24 hour emergency contact number, may not advertise the home as an event space, must complete human trafficking awareness training and must pay hotel occupancy taxes.

Operating without registration carries fines of 100 to 500 dollars per day, and platforms must remove noncompliant listings within 10 days of a city notice. City registration does not override private restrictions, so in a neighborhood where the restrictions limit use to a single family residence, read them before listing a house for short stays.

Buffalo Bayou drainage and appraisal timing

The area drains to Buffalo Bayou, a 102 square mile watershed with 106 miles of open stream and 506,362 residents in its Harris County portion as of the 2020 Census. The Harris County Flood Control District notes that a major flood occurs somewhere in the county about every two years, mostly in areas developed before modern flood risk rules, and much of River Oaks was platted in the 1920s. Check the flood history of a specific street, not just the neighborhood name.

Harris Central Appraisal District values every parcel here. The appraisal district must mail notices of appraised value by May 1, or April 1 for a residence homestead, or as soon as practical after, and the protest deadline is May 15 or 30 days after the notice is mailed, whichever is later. On rentals in this price range, a missed protest deadline is an expensive mistake.

FAQ

River Oaks Property Management FAQ

Do I need River Oaks Property Owners approval to renovate my rental?

For work covered by the deed restrictions, yes. River Oaks Property Owners reviews and enforces the residential building restrictions, so new construction, additions and substantial exterior changes go through its review in addition to any City of Houston permit. Confirm what applies to your lot before hiring a contractor.

On most lots, no. The Afton Oaks Civic Club enforces common restrictions that limit occupancy to one single family residence per lot and prohibit commercial activity. Section Seven let its restrictions lapse and has multiple dwellings, so the answer depends on which section the lot is in.

Only with a City of Houston registration, required since January 1, 2026 for short-term rentals, at 275 dollars a year per property. You also need a 24 hour emergency contact, hotel occupancy tax compliance and human trafficking awareness training. Private deed restrictions can still limit use, so read them first.

The associations and, for certain restrictions, the city. River Oaks Property Owners, the Afton Oaks Civic Club and the Avalon Property Owners Association each enforce their own. The City Legal Department can also sue to enforce restrictions on use, setbacks, lot size and structures, and takes complaints at 832-393-6333.

Houston ISD. River Oaks Elementary at 2008 Kirby Drive is a Vanguard magnet and IB World School, but attendance zones are set by address. Check the specific address with Houston ISD before naming a school in a listing.

May 15 or 30 days after Harris Central Appraisal District mails your notice of appraised value, whichever is later. Notices on non homestead property are due by May 1 or as soon as practical after, so a rental owner should watch for the notice in late April and early May.
